上列上訴人等因自訴甲○○等偽造文書案件，不服台灣高等法院
中華民國九十八年一月十九日第二審刑事附帶民事訴訟判決（九
十八年度重附民上更㈡字第二號），提起上訴，本院判決如下：
主 文
上訴駁回。
理 由
按刑事附帶民事訴訟當事人之上訴，係對於下級法院之判決聲明
不服而請求上級法院予以救濟之訴訟制度，自以受不利益之裁判，為求自己利益起見請求救濟者，方得為之。上訴人謝諒獲等人對被上訴人甲○○等人提起刑事附帶民事訴訟，經第一審法院台灣台北地方法院判決「原告之訴及其假執行之聲請均駁回」，謝諒獲等人不服，提起第二審上訴，經原審法院將其上訴部分撤銷，發回台灣台北地方法院，自屬有利於上訴人即原告謝諒獲等人之判決，謝諒獲等人仍對該有利判決提起上訴，顯為法所不許，應予駁回。又第一審法院八十五年度附民字第五０七號及原審法院九十八年度重附民上更㈡字第二號之刑事附帶民事訴訟判決之原告及上訴人均為「謝諒獲」及「美商寅○○、卡其他、申○○與吞納 MAF公司」二人，「謝謝國際聯合律師事務所」並非上開判決之原告及上訴人，其提起本件第三審上訴，亦非適法，均應予駁回。
據上論結，應依刑事訴訟法第四百九十條前段、第三百九十五條前段，判決如主文。
