原 告 Grant Jonathan Harley
被 告 黃健穎
上列當事人間請求侵權行為損害賠償事件，本院於民國113年5月
10日言詞辯論終結，判決如下：
主 文
被告應給付原告新臺幣60,000元。
原告其餘之訴駁回。
訴訟費用由被告負擔百分之12，餘由原告負擔。本判決原告勝訴部分得假執行。
事實及理由
一、原告主張：兩造原為夫妻，嗣於民國112年11月7日離婚。被 告故意於附表所示時間，在多數人可瀏覽之社群網站「Face book」（下稱「臉書」），公開張貼附表所示貼文，侮辱毀 謗原告，貶損原告人格及社會評價，侵害原告名譽，應負侵 權行為損害賠償責任，爰依侵權行為損害賠償之法律關係， 提起本件訴訟等語。並聲明：被告應給付原告新臺幣(下同 ）50萬元（見調字卷第11頁、簡字卷第47頁）。二、被告則以：我111年1月12日的臉書貼文，是藉由一首兒歌開 頭，寫了臉書，這是我的創作，我擔心遭遇不測，所以在臉 書版面寫下連警察都看的到的貼文，至於其他貼文，我是講 出事實，不帶任何髒字，沒有抵損或侵害原告之任何權利， 我是講出事實，不帶任何髒字，純粹是經由我的言語、民主 所寫出來的，如果原告要用這樣的對話請求我負損害賠償責 任，我覺得極度不合理，因為貼文裡沒人知道葛蘭特、凱羅 是誰，我皆無誹謗原告名譽的意思，我是在臉書上尋找我失 蹤3年的法定丈夫即原告，希望他能出面扶養2名未成年子女 ，我貼的內容都是事實，沒有誹謗等語置辯。並聲明：原告 之訴駁回（見簡字卷第48、56頁）。
三、得心證之理由：
㈠原告主張被告於附表所示時間，於臉書張貼附表所示貼文乙 情，業據提出臉書頁面截圖（見調字卷第17至29頁，簡字卷 第61至65頁），並為被告所不爭執（見簡字卷第56頁），堪 信為真。
㈡按因故意或過失不法侵害他人之權利者，負損害賠償責任。
不法侵害他人之身體、健康、名譽、自由、信用、隱私、貞 操，或不法侵害其他人格法益而情節重大者，被害人雖非財 產上之損害，亦得請求賠償相當之金額，民法第184條第1項 前段、第195條第1項分別定有明文。復按被害人受有非財產 上損害，請求加害人賠償相當金額之慰撫金時，法院對於慰 撫金之量定，應斟酌實際加害情形、所造成之影響、被害人 痛苦之程度、兩造之身分地位經濟情形及其他各種狀況，以 核定相當之數額。查：被告雖以前揭情詞置辯，惟被告於附 表所示時間，於多數人得共見共聞之臉書，以「loser」、 「do crime in Taiwan」、「cheater」、「Jonathan Gran t this guy steal money from my mother to pay for his tuition on this program classes」等言語指稱原告，並 標註原告臉書「Jonathan Grant」之帳號，顯已貶損原告之 人格及社會評價，被告上開指摘內容足以毀損原告名譽，依 前揭說明，應認侵害原告名譽權。從而，原告依侵權行為之 法律關係，請求被告給付原告精神慰撫金，自屬有據。 ㈢又被害人因身體、健康受侵害，致受有非財產上之損害者， 雖亦得請求賠償，惟酌定精神慰撫金之多寡時，應斟酌被害 人及加害人雙方之身分、資力、經濟狀況、加害程度、被害 人所受痛苦及及其他各種情形，以核定相當之數額。本院審 酌兩造教育程度、經濟能力、社會地位（見簡字卷第57頁， 禁閱卷之兩造財產所得調件明細資料），及本件侵權行為態 樣、對原告人格貶損之程度，及原告所受精神上痛苦程度等 一切情狀，認原告請求之精神慰撫金以60,000元為適當，逾 此數額之請求，則無理由。
四、綜上所述，原告依侵權行為損害賠償之法律關係，請求被告 給付60,000元，為有理由，應予准許；逾此部分之請求，則 屬無據，應予駁回。
五、本判決原告勝訴部分，係命被告給付金額未逾50萬元所為之 判決，爰依民事訴訟法第389條第1項第5款規定，依職權宣 告假執行。
六、本件為判決基礎之事證已臻明確，兩造其餘主張陳述及攻擊 防禦方法，經本院審酌後，認均不影響本件判決結果，爰不 一一論述，併此敘明。

And his parents block me as well not helping me to raise kids also. I wrote it down to leave a record for my kids to read when they’re older. This American man borrowed tons of money from my parents then deny to return it also lying to court he didn’t borrow. We will post more evidence to prove this man lying for everything for getting more money only from women. On more, this man hasn’t divorce with his exwife and date with another Filipino when he had sexual relatinoship with me. I found out all these during divorce suit with Jonathan Grant. If you know him I just wanna give you a warning about this guy whose name is Jonathan Harley Grant. Do not trust him or date with him due to he hasn't divorce with me until today. 7 112年6月3日 Also this American man borrowed tons of money from my parents then deny to return it, also lying to court he didn't borrow. We will post more evidence to prove this man lying for everything for getting more money only from women. One more, this man hasn't divorced with his exwife and date with another Phillippines when he had a sexual relationship with me. I found out all these during divorce suit with Jonathan Grant. If you know him I just wanna give you a warning about this guy whose name is Jonathan Grant Harley. Also he been abandoned hi daughters for 3 years not raise them with one penny. He hadn't divorced with his exwife dated with another Philippines when he had a sexual relationship with me. If someone know him please be cautious about this guy dignity.
